Terms of Service

These Terms of Service (“Terms”) govern your use of otterwatt.com and any consultation, design, installation, or ongoing service you engage Otter Watt to perform. By using our site or hiring us, you agree to these Terms.
1. About us
Otter Watt is a smart-home automation consultancy based in Massachusetts. We design, install, and support residential automation systems including lighting, voice control, climate, entry, audio, and related connected devices.
2. Consultations and quotes
Initial consultations are free and carry no obligation. After a consultation, we may provide a written proposal that describes the scope of work, hardware specifications, labor, and total price.
Quotes are valid for 30 days from the date issued. Once you sign and return a proposal, the price becomes binding for both parties for the scope described. If unforeseen conditions arise during installation that materially change the scope, we will pause and discuss any change with you in writing before proceeding.
3. Founding Client Program
Our Founding Client Program offers an introductory price guarantee to our first 10 clients (or to anyone whose project is booked before May 31, 2026, whichever comes first). Under this program:
- You will not be charged more than the price range stated on your written proposal.
- If your project’s actual cost falls below the low end of the quoted range, you will be charged actual cost in lieu of the quoted price.
- The program applies to The Spark, The Current, and The Grid packages. The Blueprint package is custom-quoted after consultation and is not part of the program.
- A booking is “counted” toward the 10-client cap when you sign a written proposal and submit any required deposit.
- We reserve the right to amend the program for clients booked after the cap is reached or after May 31, 2026.
4. Hardware
We typically source hardware (switches, sensors, hubs, speakers, locks, etc.) on your behalf at our cost plus 15%. You may instead provide your own hardware; in that case we’ll install and configure it but cannot warranty equipment we did not source.
Hardware carries the manufacturer’s warranty, which we will help you claim if a device fails within the manufacturer’s warranty period.
5. Workmanship warranty
We warrant our workmanship for 90 days from project completion. Within that period, if a system fails to operate as described in your signed proposal because of how we installed or configured it, we will return at no charge to correct the issue. The warranty does not cover damage caused by other contractors, household members, power surges, ISP outages, manufacturer firmware changes, or modifications you make after our work is complete.
6. Service plans
Service plans are billed monthly in advance. You may cancel a service plan at any time by notifying us in writing. Cancellation takes effect at the end of the then-current paid billing period; we do not pro-rate refunds for partial months.
7. Payment
For project work, we typically request a deposit at signing and the balance on completion. Specific payment terms are stated in each proposal. Invoices not paid by the stated due date may incur a finance charge of 1.5% per month on the unpaid balance.
8. Limitation of liability
To the maximum extent permitted by law, Otter Watt’s total liability arising out of or related to a project will not exceed the total amount you paid us for that project. We are not liable for indirect, incidental, special, or consequential damages (including lost data, lost productivity, or service interruptions in connected platforms outside our control).
Smart-home systems depend on third-party platforms (Apple Home, Amazon Alexa, Google Home, manufacturer cloud services, your internet connection, and others). We design systems to be reliable, but we cannot guarantee uninterrupted operation of services outside our control.
9. Intellectual property
All content on otterwatt.com (text, images, logos) is owned by Otter Watt and may not be copied, mirrored, or used without our written permission, except for personal, non-commercial reference.
10. Privacy
Our handling of your personal information is described in our Privacy Policy.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date reflects the most recent revision. Continued use of the site or our services after changes are posted constitutes acceptance of the updated Terms.
